Terms of Service

1. Acceptance

By downloading, installing, or using BurnKey ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Service Description

BurnKey provides:

• Tracking your active calories burned, exercise time, and walking/running distance via Apple HealthKit
• Rewarding physical activity with screen time
• Blocking selected apps until you earn access by burning active calories

The App requires an active subscription and access to HealthKit and Screen Time permissions to function.

3. No Account Needed

Everything is stored on your device. No sign-up, no login, no password required.

4. Subscriptions

4.1 Requirement

BurnKey requires an active subscription to use. Available plans include weekly and yearly subscriptions.

4.2 Billing

• Payment is charged to your Apple ID at purchase confirmation
• Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends
• Renewal is charged within 24 hours before the period ends at the same price

4.3 Management & Cancellation

• Manage subscriptions: iOS Settings → Your Name → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds for unused portions of a subscription period
• If your subscription expires, app blocking features will be disabled

4.4 Free Trial

If a free trial is offered, unused trial time is forfeited upon purchasing a subscription. After the trial ends, a paid subscription is required to continue using the App.

4.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple, not us. All purchases are final unless Apple's refund policy applies.

5. HealthKit Usage

By granting HealthKit access, you acknowledge:

• Your health data is used solely to calculate earned screen time
• Health data remains on your device and is never transmitted to external servers
• BurnKey reads the following data only: Active Energy Burned, Apple Exercise Time, and Walking or Running Distance
• BurnKey does not write data to Apple Health
• You can revoke access at any time in iOS Settings → Health → Data Access & Devices

6. Screen Time Usage

By granting Screen Time access, you acknowledge:

• The App can block apps you select until you earn access by burning active calories
• You can unblock apps by earning calories or adjusting settings
• We are not responsible for missed notifications from blocked apps
• You can revoke access at any time in iOS Settings → Screen Time

7. User Responsibilities

You agree to:

• Use the App in compliance with applicable laws
• Not circumvent, bypass, or manipulate app blocking through unauthorised means
• Not reverse engineer, decompile, or exploit bugs in the App
• Consult a healthcare professional before starting any exercise program
• Ensure minors have parental consent before using Screen Time features

We may restrict access if you violate these Terms.

BurnKey is rated 4+ on the App Store. Parents and guardians are responsible for supervising minors using the App.

10. Third-Party Services

No data is sold. No ads.

11. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee:

• Accuracy of calorie or activity data (depends on device sensors)
• Uninterrupted availability
• That the App will meet your specific requirements
• That the App will improve your health or fitness

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data or productivity
• Damages from blocked app access
• Health decisions based on App data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding any claim.

13. Intellectual Property

The App, including its design, code, and content, is owned by BurnKey and protected by intellectual property laws. You may not copy, modify, or distribute the App without permission.

14. Termination

We may terminate or suspend your access for violation of these Terms. Upon termination, your right to use the App ends immediately.

15. Changes

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated within the App.

16. Governing Law

These Terms are governed by the laws of Australia. Disputes shall be resolved in the courts of Australia.

For EU consumers: You retain rights under the consumer protection laws of your country of residence.

17. Apple App Store Terms

As required by Apple for App Store distribution:

• These Terms are between you and BurnKey, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims relating to the App, including product liability, consumer protection, or intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
